SPINSHOT EVENTS – TERMS & CONDITIONS
These Terms & Conditions set forth an agreement between SpinShot Events (ABN 39 127 855 686) (referred to as “we”, “us”, “our”, or “the Provider”) and you (referred to as “the Client”, “you”, or “your”) for the hire of our goods and services.
These Terms & Conditions constitute the entire agreement between both parties and supersede all prior written and/or oral agreements.
AGREEMENT & ACCEPTANCE
By submitting a booking form, event details form, or making any payment to SpinShot Events, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
Submission of the event form and/or payment of any invoice constitutes a legally binding agreement, and no physical or digital signature is required.
BOOKING CONFIRMATION
Your booking is confirmed only when:
A completed event form is submitted, and
The required booking fee has been paid
BOOKING FEE
A booking fee of 30% is required at the time of booking all our photo booths, with the remaining balance to be paid no later than 72 hours prior to your event. The booking fee is non-refundable if cancellation occurs by the Client.
Final payment is non-refundable unless no service is provided by SpinShot Events.
SpinShot Events cannot be held responsible for unforeseen delays at the venue outside of our control. If service is impacted due to such delays, full payment will still be required.
SERVICE PERIOD
In the event the Provider is unable to supply a working Photo or Video Booth for at least 80% of the service period, the Client shall be refunded a prorated amount based on the amount of service delivered. If no service is delivered, liability is limited to a full refund of payments received.
Spare equipment may be supplied subject to availability. If printing fails onsite, the Provider may provide an online gallery for guests to download images.
ACCESS & PARKING
Any parking fees associated with the delivery, operation, and removal of equipment are to be covered by the Client.
The Client will arrange access to the venue and provide any necessary passes, tickets, or permissions required for entry.
The Client agrees to ensure safe and convenient access. A fee of $50 will be charged if lift access is unavailable for equipment transport.
SETUP REQUIREMENTS
The Client must provide a safe environment in which to operate. A flat, hard, solid, level surface is required.
A standard 240V power outlet must be available within 10 feet of the setup area.
The setup area must be indoors or under a secure covering with no risk of rain or water exposure.
The Provider reserves the right to deny use of equipment to any individual who may cause damage or disruption.
If conditions become unsafe and an alternative location cannot be provided, the Provider reserves the right to cease service without refund.
EQUIPMENT
The Provider will handle setup and pack down of all equipment.
The Client is responsible for ensuring equipment is used appropriately and safely by all guests.
The Client will be liable for any damage, loss, or theft of equipment caused by misuse by the Client or their guests.
This includes, but is not limited to:
Misuse of equipment
Theft
Fire, flood, or natural disaster
Power loss or surges affecting equipment or data
The Provider reserves the right to refuse service to any guest displaying inappropriate or unsafe behaviour.
PROPS
Props must remain within the designated booth area. Any lost or stolen items will be charged to the Client.
The Provider may remove props if they are being damaged or misused.
Children under the age of 10 must be supervised when using props or equipment.
CHANGES TO BOOKING
Changes to booking details must be made in writing at least 14 days prior to the event.
Guest numbers exceeding 200 per booth may incur additional charges.
Date change requests must be made at least 30 days prior and are subject to availability.
If a new date is unavailable, the booking fee will be forfeited.
CANCELLATIONS
If the Client cancels without prior agreement, the full invoice amount remains payable.
Failure to pay the final balance at least 24 hours prior to the event will be treated as cancellation, and all payments made will be forfeited.
FORCE MAJEURE
SpinShot Events will not be held liable for failure to perform due to circumstances beyond our control, including but not limited to natural disasters, extreme weather, acts of terrorism, labour disruptions, or emergencies preventing service delivery.
SECURITY STATEMENT
Our banking details will only be provided on official invoices and will not change. If you receive any communication requesting payment changes, please verify directly with us. We are not responsible for payments made to incorrect accounts.
INTERNET ACCESS
Some services require internet connectivity for instant sharing.
The Provider is not responsible for network reliability at the venue.
If connectivity is unavailable, all content will be delivered within 7 days after the event.
INDEMNIFICATION
The Client agrees to indemnify and hold harmless SpinShot Events from any liability related to the event.
The Client accepts responsibility for any claims arising from the use of photos or videos taken at the event.
In the unlikely event of lost or corrupted media, liability is limited to a maximum of $250.
MEDIA RELEASE
All guests using the photo booth or 360 booth grant SpinShot Events permission to use images and videos for promotional, marketing, and advertising purposes.
The Client releases SpinShot Events from any liability arising from the use or publication of such content, including claims of libel or invasion of privacy.
If any guest does not wish to be photographed or published, the Client must notify us in writing at least 7 days prior to the event.
TRAVEL & ACCOMMODATION
A travel surcharge applies to events located more than 25km from Craigieburn, Victoria.
If the event is more than 2 hours away and ends after 11pm, the Client must cover overnight accommodation costs. If a motel is unavailable, a hotel or Airbnb will be accepted.
A minimum travel fee of $50 applies.
ADDITIONAL TERMS
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain valid and enforceable.
ENTIRE AGREEMENT
This agreement represents the entire agreement between the Provider and the Client and may only be amended in writing by SpinShot Events.
FINAL ACKNOWLEDGEMENT
By submitting your event booking form and/or making payment, you confirm that you have read, understood, and agreed to these Terms & Conditions in full.
